In autumn 2015, the Commission presented a new model for dispute settlement on investment protection in the course of the TTIP negotiations: The Investment Court System. This model has been included in recent agreements with Canada (CETA) and Vietnam. It is also the intention to develop a Multilateral Investment Court, along the same lines. The new system introduces, among others, an appeal mechanism and new rules for selecting arbitrators.

Numerous critics argue that the new system means only a cosmetic change from the old ISDS, as fundamental problems in the investment protection regime have not been addressed: it is a system that only gives rights and no obligations to investors, it discriminates against domestic investors and citizens and the arbitrators don't comply with basic requirements for independent judges. It is also questionable if ICS is in line with EU Treaties.

In the run up to the upcoming decisions concerning CETA in the European Council and the European Parliament, AK, ÖGB and FoE Europe organise a debate on the question: Is ICS a fundamental change from ISDS or not?
